On Friday, Gov. Cuomo announced the nomination of Leslie Stein, an Associate Justice of the Appellate Division, to replace Victoria Graffeo on the state’s highest court, the Court of Appeals.

Justice Stein, an Albany County resident, has served as a justice or judge on New York’s courts for the last 17 years.

The appointment will fill a vacancy that results from the expiration of Judge Victoria Graffeo’s 14-year term. The nomination is subject to the approval of the State Senate.  If she is approved, Democrats will have a majority on the seven-member court for the first time since 2003.

There will be another vacancy on the Court of Appeals at the end of 2014 when Judge Robert Smith must retire because he has reached age 70.
