The state Appellate Division court has upheld the state’s MTA payroll tax, which supports the operations of the Metropolitan Transit Authority (MTA).


Last week, the Appellate Division, Second Department held that the MTA payroll tax was a “special law” of importance to the entire state, and therefore it did not require “home-rule” messages from local governments when it was first enacted in 2009.


Nassau County Executive Edward Mangano, who is challenging the law, promised to appeal the decision to the Court of Appeals.
