Last Tuesday, Gov. Cuomo announced that he has approved legislation prohibiting telemarketers from using prerecorded telephone messages in telephone calls unless recipients choose to receive them. The new law gives the state’s Department of State the authority to ban telemarketing companies from doing business in the state if they violate the law.

The new law does not prohibit automated “robo calls” by political campaigns, as such calls are authorized under federal law.

Gov. Cuomo said:

“Unwanted telemarketing calls are intrusive and irritating.  This legislation is designed to ensure that New Yorkers who choose not to receive these promotional messages are not forced to deal with these harassing phone calls.”
